Deducting treatment costs for tax purposes – what can count as extraordinary expenses

Anyone who pays for their treatment themselves can often declare the costs as an extraordinary burden in their income tax return. Requirements, pitfalls and the steps at a glance.

What many people overlook

Money back from the tax office

Treatment at the Weight Doctors® is an investment in your health – and for many patients initially a self-pay service. At first glance that feels like a lot. In the public discussion, what often gets lost is that treatment costs can in many cases be claimed as extraordinary expenses in the income tax return. That can mean a tax refund of several thousand euros.

This article shows what is possible, which conditions must be met, where the pitfalls lie – and how our tax benefit calculator can give you a first indication in a few minutes.

This article is not tax advice. We are specialists in sustainable weight loss, not tax advisers, and can neither guarantee a refund nor assess your individual tax situation. Please discuss your case with your tax adviser or check it with tax software.

The principle

What lies behind the term “extraordinary expenses”

The legislator recognises that there are situations in life in which people have to bear expenses that are well above the usual – for example for medically necessary treatment. This is where extraordinary expenses come in.

  • The logic behind itEvery taxpayer has a personal reasonable-burden threshold. Up to this threshold you bear health expenses yourself. What lies above it you can claim for tax purposes – part of it comes back through the tax refund.
  • The reasonable-burden threshold depends on three factorsYour annual taxable income, your marital status and the number of your dependent children. That is why there is no flat-rate result – but there are reliable ballpark figures.

How much can come back

From our patients’ feedback we know: often around 30%, sometimes 40%, of the total treatment costs come back through tax. How much it is for you depends on your income, your marital status and the number of your children – with a larger treatment such as the Weight Doctors SLEEVE®, that can quickly be a four-figure amount.

Medication and additional medical services connected with your medical treatment also count. So keep every invoice and every receipt – every document can count.

So that the tax office accepts it

These 5 conditions must be met

For the tax office to recognise your treatment as extraordinary expenses, these points above all matter:

  • Liable to tax in GermanyIn the year in which you were treated, you were assessed for tax in Germany.
  • Correct tax yearThe treatment took place in the calendar year for which you are filing the return. This is also possible retrospectively, even if the return for that year has already been submitted.
  • Medical treatmentThe treatment must have been medically necessary. The yardstick is generally BMI – from 35 with related conditions, or from 40.
  • Insurance irrelevantWhether statutory, private or with no insurance benefit – what matters is what you paid yourself.
  • Above the reasonable-burden thresholdYour treatment costs must be above your personal reasonable-burden threshold. With treatment at the Weight Doctors®, this is the case for most patients.

Which treatments come into question

Where there is a medical indication in line with the guidelines, the entire range of Weight Doctors® treatments can be relevant for tax purposes. The most common treatments and their order of magnitude – all prices and services in detail are in the overview of services:

TreatmentWhat it involvesCosts
Weight Doctors SLEEVE®Permanent stomach reduction without a conventional operation, with pose® 3.0 Double Helix or OverStitch NXT™from €5,500
Weight Doctors BARIATRICS®Gastric bypass or gastric sleeve surgery, incl. private medical preliminary examination and aftercarefrom €2,500

Weight Doctors® RESHAPEBody contouring after weight loss by specialists in plastic surgeryfrom €1,950

With each of these treatments it is worth looking at your tax return – often more than patients first suspect.

Payment in instalments

Deductible even with financing

A common question is: “I am financing my treatment through medipay – can I still deduct something for tax?” Yes. Whether you pay all at once or in monthly instalments does not rule out tax recognition.

What matters are the treatment and the costs you can prove. In which year you claim the costs when financing is involved is best discussed with your tax adviser.

And what is really true

Four common misconceptions

  • “It only pays off for high earners”Not true. The reasonable-burden threshold is graded by percentage. With small and medium incomes in particular, the refund rate can be high, because a larger share of the costs lies above the threshold.
  • “If the German health insurer doesn’t pay, there is nothing in it for tax”On the contrary. It is precisely because you pay yourself that extraordinary expenses come into play. Whether you are insured or self-paying has nothing to do with tax recognition.
  • “With payment in instalments the tax benefit lapses”Not true. You can also claim financed treatment costs.
  • “My tax return has already been submitted – too late”Not necessarily. Retrospective claims are still possible in many cases, even if the return for the year of treatment has already been submitted. If the claim is justified, the money is not lost for several years.
Step by step

In 4 steps to a possible refund

  1. Collect documentsInvoices for your treatment, receipts for accompanying medication and additional medical services. Every document counts.
  2. Check the key dataYour taxable income, your marital status and the number of your dependent children in the year of treatment.
  3. Calculate in advanceThe Weight Doctors® tax benefit calculator gives you, in a few clicks, a first indication of the amount you can expect.
  4. File the returnEnter the treatment costs as extraordinary expenses – with your tax software or together with your tax adviser. The refund comes with the income tax assessment for the year of treatment.

Whether a noticeable refund results in the end is something we cannot promise – but it is almost always worth checking.

Frequently asked questions

Questions and answers

Your question isn’t listed? Your specialist will take time for it during the consultation.

Which treatments can I deduct for tax?

Where there is a medical indication in line with the guidelines, the entire range of Weight Doctors® treatments can count as extraordinary expenses – from the Weight Doctors SLEEVE® through Weight Doctors BARIATRICS® and the gastric balloon to GLP-1 therapy and Weight Doctors® RESHAPE. Medication and additional medical services that form part of the medical treatment also count.

What conditions must I meet for the tax office to recognise the treatment?

You were liable to tax in Germany in the year of treatment, the treatment was medically necessary (the yardstick is generally a BMI from 40, or from 35 with related conditions), and your costs are above your personal reasonable-burden threshold. Whether you have statutory insurance, private insurance or none at all does not matter – what counts is what you paid yourself.

Can I deduct the treatment for tax even if I pay in instalments?

Yes. Whether you pay all at once or in instalments through medipay makes no difference to tax recognition. In which year you claim the costs is best clarified with your tax adviser.

My tax return for the year of treatment has already been submitted – is it too late now?

Not necessarily. The costs can often still be claimed retrospectively, even if the return for that year has already been submitted. Speak to your tax adviser about this or check it in your tax software.

Does the tax benefit replace missing cost coverage by the German health insurer?

No, one is not a substitute for the other. Where there is a medical indication in line with the guidelines, we check every possible cost coverage by the German health insurer – for stomach reduction entirely without an advance application. Where that is not possible, extraordinary expenses can bring part of the costs back for self-paying patients. The two complement each other.

Can Weight Doctors® advise me on my tax return?

No. We are neither permitted nor able to provide tax advice. What we do: we make all treatment receipts available to you transparently, and our tax benefit calculator gives a first indication. For the actual implementation, please turn to your tax adviser or use tax software.
